Private Costs
In privately funded cases we will provide you with: –
- an estimate of costs or a fixed fee quotation
- a date for the first payment on account
- a date for payment in full
Where we have not provided you with a fixed fee quotation for the costs of your case we advise you that our charges will be calculated by reference to the time spent by members of this office dealing with your case at a rate of £220 per hour (plus VAT) in respect of advice, attendances on you and others, preparation (including correspondence and telephone calls) Court appearances, travel and waiting. In complex cases the charging rate may be enhanced when additional care and conduct is required but this will be advised to you at the outset.
We will of course keep you advised of costs as the case proceeds.
It is normal practice to ask clients to make payment on account of anticipated costs. It is helpful if you meet those requests promptly, but if there is any difficulty please let us know as soon as possible. We are sure you will understand that in the event of a payment not being made we must reserve the right to decline to act further and that the full amount of work done up to that date will be charged to you. If there is any expense which has to be undertaken in addition to our own fees we will of course advise you as far as possible of the amount of that expense.
If, at the conclusion of a case, costs of the case are awarded by the Court, you will be entitled to repayment of the costs you have paid us.
As a result of requirements placed upon us by UK Government regulations concerned with money laundering we are obliged in private cases to request from you some personal documentation (e.g. passport, driving licence, birth certificate, utility bill) to establish identity.
Expenses / Disbursements:
If your case is one which requires us to use outside agencies in the preparation of your case the expenditure incurred will be in addition to our own legal costs. This is subject to a number of important points:-
- we will ascertain the cost of any expenditure and advise you of it
- we will not instruct an outside agency nor incur any expense on your behalf without express consent
- due to our accounts rules the fees incurred will have to be paid directly by you and not through this office. We cannot accept liability for the debit incurred to an outside agency.
