Further Success in Encrochat Trial (Subject to Prosecution Appeal)

The Prosecution evidence had lasted for just under 3 months. At the close of the Prosecution’s case, applications were made to the trial Judge. Earlier this week, as a result of the Judge’s ruling, the trial against ‘SM’s client could not proceed
However, due to the fact that the Judge’s ruling was a terminating ruling this would allow the Prosecution an automatic right to appeal the Judge’s decision.
As a consequence of what took place earlier this week, the jury who had been in charge of the case for just under 3 months were discharged. The case will next be heard at the Court of Appeal, London, in 2024.
Unfortunately, due to the fact that the case is subject to a Prosecution appeal, reporting restrictions were imposed by the trial Judge. Therefore, at this stage full details of the case cannot be provided. They will be provided once the appeal hearing has taken place.
This outcome follows the acquittal, on Friday 1st December 2023, of another one of SM’s clients at Birmingham Crown Court. AS was found not guilty by the jury following a 10 week trial. AS was alleged to have been the user of 2 Encro handles, and was said to have been involved in the supply of large quantities of Class A drugs (Cocaine).
